This is the personal information processing policy (“Privacy Policy”) that governs how Top Games, Inc. and our affiliated companies ("Top Games", "we", "our" or "us"), use Personal Data (defined below) that we collect, receive and store about you in connection with your use of our website: www.topgamesinc.com and any other website or application that we operate, or our partners operate on our behalf, (each, together with its sub-domains, content and services, a "Site"). Our Site may contain links to third-party websites and services that are not owned or controlled by Top Games. We are not responsible for the privacy practices or the content of third party websites, services and advertisements, and you visit them at your own risk.

1. Introduction.
We are committed to respecting privacy and recognize the need for appropriate protection and management of any Personal Data that is shared with us as part of using our Site. As used in this Privacy Policy, "Personal Data" means any information that may be used, either alone or in combination with other information, to personally identify an individual.

2. Changes to this Privacy Policy.
We reserve the right, at our discretion, to change the terms of this Privacy Policy at any time. You can see when this Privacy Policy was last updated by reviewing the “Last Updated” legend on the top of this page. We may provide you with notice of material changes to the Privacy Policy as appropriate under the circumstances. UNLESS OTHERWISE INDICATED, ANY CHANGES TO THIS PRIVACY POLICY WILL APPLY IMMEDIATELY UPON POSTING TO THE SITE.

3. Personal Data Collected.
3.1 Data Controller
Top Games, Inc. is the data controller of your personal information. Top Games, Inc. can be reached at legal@topgamesinc.com or at Top Games US, Inc, 1603 Capitol Ave., Ste. 310 A436, Cheyenne, WY 82001.

3.2. Personal Data You Provide To Us On Our Site.
a) Types of Personal Data. We and our service providers collect the Personal Data set forth below in order to provide the Site to you, or because we are legally required to do so. If you do not provide the Personal Data we request, we may not be able to provide you with the Site.

The Personal Data we and our service providers collect includes but is not limited to:
Email address;
Payment information;
Phone number;
Communications you send to us.

b) When Personal Data is Collected.
You may be required to provide us with certain information that may constitute Personal Data in the following ways:

Contact Information.
In various areas of the Site, we provide you the opportunity to submit a form with basic contact information, such as your email and payment information. With your permission, Top Games uses such information to inform you of new products, technical information and services, and upcoming events that may be of interest. If you no longer wish to receive these emails, the opt-out process is described in Section 7.2 of this Privacy Policy.

In addition, if you choose, you may participate in a Top Games e-mail list server by subscribing within the Site or by contacting Top Games staff directly. You may unsubscribe from these e-mail list servers by following the unsubscribe instructions found within the list email.

Member Login Information.
We process your username and password to enable you to securely log into the Site, and we process information regarding your role with Top Games to appropriately control access to restricted content. We process this Personal Data only as necessary to provide you services on the Site under our Terms of Use and to further our legitimate interests in protecting the Site and content.

Payment Information. When you purchase services or products from us, third-party service providers acting on our behalf process payment information, including payment card details and billing addresses, to help us fulfill your orders. Any Personal Data collected by such third party will be subject to the third party’s privacy policy, rather than this Privacy Policy.

Information Collected through Various Forms.
We and our service providers may collect Personal Data in a variety of ways, including: (i) through use of the Site, e.g., when you sign up for a gaming service, forum community, or make a purchase; or (ii) from other sources, such as public databases, joint marketing partners, social media platforms (including from people with whom you are friends or otherwise connected) and from other third parties.

Personal Data You Disclose Relating to Others.
If you disclose any Personal Data relating to other people to us or to our service providers in connection with the Site, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

3.3. Personal Data You Provide To Third Parties On Our Site.
Please note that we use certain third party service providers on our Site to enhance your experience or deliver certain services. These providers may collect Personal Data about you in performing their services and/or functions on our Site.

3.4. Information Collected Automatically
Certain information on our Site is collected automatically by means of various software tools. We have a legitimate interest in using such information to assist in log-in, systems administration purposes, information security and abuse prevention, to track user trends, and to analyze the effectiveness of our Site. Alone or in combination with other information, such automatically collected information may constitute Personal Data. Some of our service providers (described in Section 5, below) may use cookies or other methods to gather information regarding your use of our Site. Such third parties may use these cookies or other tracking methods for their own purposes by relating information about your use of our Site with any Personal Data about you that they may have. The use of such information by a third party depends on the privacy policy of that third party. a) Log Files On Our Site. The information inside the log files includes internet protocol (“IP”) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us. b) Cookies. We use cookies to make interactions with our Site easy and meaningful. When you visit our Site, our servers may send a cookie to your computer. We may use cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer. Please note that if you disable your web browser’s ability to accept cookies, you will be able to navigate our Site, but you may not be able to successfully use all of the features of our Site. The following sets out how we may use different categories of cookies and your options for managing cookies’ settings:

These cookies can also be used to remember changes you have made to text size, fonts and other parts of web pages that you can customize. We may use local shared objects, also known as Flash cookies, to store your preferences or display content based upon what you view on our Site to personalize your visit. Targeting or Advertising cookies	From time-to-time, we may engage third parties to track and analyze usage and volume statistical information from individuals who visit our Site. We sometimes use cookies delivered by third parties to track the performance of our advertisements. For example, these cookies remember which browsers have visited our Site. By way of example, as you browse our Site, advertising cookies may be placed on your computer so that we can understand what you are interested in. Our advertising partners then enable us to present you with retargeted advertising on other sites based on your previous interaction with our Site. We also contract with third-party advertising networks and similar partners that collect IP addresses and other information from web beacons (see below) on our Site, from emails, and on third-party sites. Ad networks follow your online activities over time by collecting Site Navigational Information through automated means, including through the use of cookies. They use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other websites. This process also helps us manage and track the effectiveness of our marketing efforts. Third parties, with whom we partner to provide certain features on our Site or to display advertising based upon your web browsing activity, use Flash cookies to collect and store information. Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored. c) Other Tracking Technologies.
When you visit our Site, we may collect your IP address for tracking purposes. For example, we may use IP addresses to monitor the regions from which you navigate our Sites. We may also use web beacons alone or in conjunction with cookies to compile information about your usage of our Site and interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular site tied to the web beacon. For example, we may place web beacons in marketing emails that notify us when you click on a link in the email that directs you to our Site. We may use web beacons to operate and improve our Site and email communications.

d) Analytics Software Tools.
We use Google Analytics on our Site to help us analyze the traffic on our Site. For more information on Google Analytics’ processing of Personal Data, please see http://www.google.com/policies/privacy/partners/. By using a browser plugin http://www.google.com/ads/preferences/plugin/ provided by Google, you can opt out of Google Analytics.

4. The Purposes For Which We Use Personal Data.
If you submit or we collect Personal Data through our Site, then such Personal Data may be used in the following ways: (i) to provide, analyze, administer, and improve our Site and services, (ii) to contact you in connection with our Site and certain services, notifications, events, programs or offerings that you may have registered for, (iii) to send you updates and promotional materials that you have registered for, (iv) to identify and authenticate your access to the parts of our Site and services that you are authorized to access, (v) to provide customer service support, including but not limited to in-app communication and tickets; (vi) for recruiting and human resources administration purposes, (vii) to protect our rights and/or our property and to ensure the technical functionality and security of our Site, and (viii) To conduct academic research independently or in collaboration with external institutions for the purpose of enhancing gaming experience.

5. How We Disclose Personal Data.
We do not sell, lease, rent or otherwise disclose the Personal Data collected from our Site to third parties unless otherwise stated below or with your consent.

5.1. Our Third Party Providers.
We transfer Personal Data to our third party service providers as necessary to perform tasks on our behalf and to assist us in providing our Site, as more fully described in Section 3.2. We use commercially reasonable efforts to only engage or interact with third party service providers and partners that post a privacy policy governing their processing of Personal Data. Notwithstanding the foregoing, we will comply with applicable laws regarding Personal Data transfers as well as any transfer restriction that is specified in an agreement between Top Games and a customer.

5.2. Social Media Services.
Third-party social networks that provide interactive plug-ins or social networking features (for example, to allow you to "Like" a page on our Site) on the Site, may use cookies or other methods (for example, web beacons) to gather information regarding your use of our websites and apps. The use of such information by a third party depends on the privacy policy available on that social network’s website, which we encourage you to carefully review. Such third parties may use these cookies or other tracking methods for their own purposes by relating information about your use of our site with any of your Personal Data that they may have.

5.3. Advertising.
We engage advertising services to assist us in advertising our brand and Site. From time to time, those services target advertisements on third-party websites based on cookies or other information indicating previous interaction with our Site.

5.4. Business Partners
From time to time, we may partner with other companies to jointly offer products or services. For example, we partner with various game development and design studios to deliver you gaming services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share Personal Data collected in connection with your purchase or expression of interest with our joint promotion partner(s). We do not control our business partners’ use of Personal Data we collect, and their use of the information will be in accordance with their own privacy policies.

5.5. In the Event of Merger, Sale, or Change of Control.
We may transfer or assign this Privacy Policy and any Personal Data to a third party entity that acquires or is merged with us as part of a merger, acquisition, sale, or other change of control.

5.6. Other Disclosures.
We may disclose Personal Data about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our terms of use, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of Top Games, our users, or the public.

5.7. Academic Research.
To conduct academic research independently or in collaboration with external institutions for the purpose of enhancing gaming experience, we may share anonymized user data with research partners. This data undergoes thorough encryption to protect privacy. You may withdraw from future research data sharing at any time by opting out via: Settings > Privacy Policy > Toggle off "Academic Research Data Sharing".

5.8. Mobile Apps: Advertising ID, Install Attribution and In-App Ads.
This Section applies to our mobile apps, including Real Games Now.
(a) Install attribution. We and our attribution partner Adjust use your device's advertising ID to attribute app installs to the ad you interacted with, so that we can measure which ads and campaigns work. On iOS, we access your device's advertising identifier (IDFA) only if you allow tracking when the app asks for your permission through Apple's App Tracking Transparency prompt; if you allow it, we share the IDFA with Adjust for install attribution and ad measurement. If you do not allow tracking, we do not access the IDFA. Separately, Adjust may estimate which ad led to an install using short-lived information, such as the time of the ad click and of the install, IP address and basic device information (for example, device model and operating system version); this estimate does not use the IDFA or any other persistent identifier, and it does not depend on whether you allow tracking. When we match installs to ad clicks on our own servers, our matching records keep only a one-way hash of the advertising ID, and we use those records only for install attribution, ad measurement and fraud prevention. Other uses of the advertising ID are described elsewhere in this Section 5.8, including Section 5.8(d). We do not use the advertising ID for attribution if it has been deleted or is unavailable on your device. (b) In-app ads. Our apps may show ads, including rewarded video ads that you choose to watch in exchange for an in-game reward. These ads are served through Google AdMob and AppLovin MAX, and may come from Google, AppLovin or Meta Audience Network. Ads may be non-personalized or personalized. Non-personalized ads are selected based on context, such as the app you are using and your general location (for example, your country), rather than on your past activity. Personalized ads are also selected based on your activity in other apps and websites, which our advertising partners link to your device's advertising ID. In Real Games Now on Android, ads may be personalized. They are not personalized (and in some of these cases no ads are shown) if:
- you turned on "Do Not Sell or Share My Personal Information" in the app or on our website (an opt-out on our website reaches the app on that device within 15 business days);
- your browser sent a Global Privacy Control signal when you signed in to your account;
- you turned off ads personalization or deleted your advertising ID in your Android settings;
- we know you are under 18; or
- you are in the European Economic Area, the United Kingdom, Switzerland or Canada, or we cannot tell which country you are in.
On iOS, Real Games Now shows only non-personalized ads. Our advertising partners may collect device information, such as device identifiers (on iOS, the IDFA only if you allow tracking), IP address (which may be used to estimate your approximate location), your interactions with ads, and diagnostic information such as crash and performance data, to deliver ads (including, for personalized ads, to select ads based on your activity in other apps and websites), limit how often you see the same ad, measure ad performance and prevent fraud. (c) Your choices. You can reset or delete your advertising ID, or opt out of ads personalization, in your device settings: on Android, under Settings > Google > Ads (or Settings > Privacy > Ads); on iOS, you can allow or stop tracking for each app at any time under Settings > Privacy & Security > Tracking, and manage Apple's own ads under Settings > Privacy & Security > Apple Advertising.
(d) Ads for our other games on other services (United States, Android only). If you use Real Games Now on an Android device in the United States and have not opened the app for at least 7 days, we may share your device's advertising ID with advertising platforms, currently Meta Platforms, Inc. and Unity Technologies, so that they can show you ads for other games in Real Games Now on their services and in other apps and websites in their ad networks (for Meta, this includes Facebook and Instagram). We share only the advertising ID. We do not share your name, email address or how you play.
We do this only with advertising IDs we collected after showing you a notice about it in the app. We never do it if:
- you turned on "Do Not Sell or Share My Personal Information" in the app or on our website;
- your browser sent a Global Privacy Control signal when you signed in to your account;
- you turned off ads personalization or deleted your advertising ID in your Android settings; or
- we know you are under 18.
If you opt out after we have shared your advertising ID, we remove it from the lists we gave these platforms within 24 hours. Each list is deleted at the platform on the day the campaign ends. We delete our own copy of a list 30 days after the campaign ends. We keep a record of each upload for 13 months; it holds only a short one-way code made from the advertising ID, not the advertising ID itself.
Under California law this is "sharing" of personal information for cross-context behavioral advertising. Under other U.S. state privacy laws it is "targeted advertising". You can opt out at any time as described above.

6. Retention of Personal Data.
We reserve the right to retain any Personal Data as long as the Personal Data are needed to: (i) fulfill the purposes that are described in Section 4 (The Purposes For Which We Use Personal Data), and (ii) comply with applicable law.

7. Your Rights.
7.1 Personal Data.
If you have an account on our Site, we provide access to—and the ability to edit or delete—certain categories of Personal Data through the account. If you would like to access, amend, erase, export (i.e., data portability), or object to or restrict the processing of Personal Data collected via our Site, you may submit a request

Depending on where you live, you may have a right to lodge a complaint with a supervisory authority or other regulatory agency if you believe that we have violated any of the rights concerning Personal Data about you. We encourage you to first reach out to us at legal@topgamesinc.com so we have an opportunity to address your concerns directly before you do so.

If you are a resident of California, please see Section 12 for additional information concerning your rights under California law.

7.2. Opting-Out of Promotional Emails.
You may choose not to receive future promotional or advertising emails from us by selecting an unsubscribe link at the bottom of each email that you receive from us, or by responding to the emails directly and requesting removal if such a link is not available. Additionally, you may send a request specifying your communications preferences to legal@topgamesinc.com. Customers cannot opt out of receiving transactional emails related to their account with us or our services. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any "Contact Us" request as well as administrative, maintenance and operational emails (for example, in connection with a password reset request).

7.3 Deletion of Data and Accounts.
We provide various methods for users to delete accounts and data. Each of these is permanent and can not be reversed; also, all games, assets and history will be permanently deleted.
Requests for data deletion will also mean the account will be closed and deleted as we require personal data for the purposes described in Section 4 to keep accounts active and open.
To delete data and your account:

7.4 Assistance for People With Disabilities.
If you have a disability which makes it at all difficult to exercise any of your rights in our Privacy Policy, we will assist. 8. Personal Data Transferred Internationally.
If you use the Site from outside the United States, please be aware that personal information may be collected, stored, and processed in the United States and Canada. If we transfer personal information internationally, we take steps to provide adequate safeguards, such as entering into standard contractual clauses with our service providers. Please be aware that the data protection laws of the United States might not be as comprehensive as those in your country.

9. Data Security.
The security of Personal Data is important to us. We follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Data, we cannot guarantee its absolute security.

10. Children's Privacy.
10.1. Children Under 13.
Children under the age of 13 should not use our websites or games at any time. In the event that we confirm that we have inadvertently gathered personal information from children under the age of 13, we will take reasonable measures to promptly remove such information from our records. We do not knowingly collect or store any Personal Data from children under 13. If parents believe that we have unintentionally collected their children’s’ Personal Data, they may request the deletion of the information by contacting us at:

10.2. Note to Parents.
We recognize a special obligation to protect Personal Data about young children. We urge parents to instruct their children to never give out their real names, addresses, or phone numbers, without permission, when on-line. Teenagers under the age of 17 and over the age of 12 should encourage their parents to review this Privacy Policy and to contact us if they would like to evoke our opt-out policy or to raise any concerns.

11. How We Respond to Do Not Track Signals.
Top Games does not track Site users over time and across third party websites to provide targeted advertising. Accordingly, we do not currently respond or take any action with respect to web browser "do not track" signals regarding the collection of Personal Data about an individual consumer's online activities over time and across third-party web sites or online services. We treat a Global Privacy Control signal as a request to opt out of the sale and sharing of your personal information and of targeted advertising. In our mobile apps, we and our attribution and advertising partners may use your device's advertising identifier (on iOS, only if you allow tracking) to attribute installs to ads, to measure ad performance across other companies' apps, to show you personalized ads in Real Games Now on Android (see Section 5.8(b)) and, as described in Section 5.8(d), to show you ads for our other games on other services. Our attribution partner may also estimate which ad led to an install using short-lived information that is not a persistent identifier. See Section 5.8.

12. Your California Privacy Rights.
This section applies to our collection and use of “Personal Information”, as defined under California law, if you are a resident of California.
Categories of Personal Information Collected, Used, and Disclosed
“Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. In accordance with California law, we collected the following categories of Personal Information within the preceding 12 months:

Identifiers such as your name, alias, email address, mailing address, IP address, and online identifiers;
Certain categories of Personal Information described in subdivision (e) of California Civil Code Section 1798.80;
Internet or other electronic network activity information, including information on your usage of our Website (“Usage Information”);
Information used to create a profile about a consumer reflecting the consumer’s preferences or behavior; and
Commercial information, including records of products or services purchased or other purchasing histories.

We disclose each of these categories of Personal Information to our service providers to the extent necessary for them to facilitate our business purposes (including any purpose specified in Section 4, above). Additionally, within the past 12 months, some of our online advertisers may have used and disclosed Usage Information collected automatically from the Service. This may be a “sale” as broadly defined under the CCPA. Therefore, we provide you the right to opt out of this “sale” of Personal Information as described, below.
Sharing for ads on other services. As described in Section 5.8(d), we may share the following categories of Personal Information with advertising platforms (currently Meta Platforms, Inc. and Unity Technologies) so that they can show you ads for our other games: Identifiers (your device's advertising ID) and Internet or other electronic network activity information (the fact that you have not opened the app recently). This is "sharing" for cross-context behavioral advertising under California law. You can opt out at any time as described in Section 5.8(d).
Personalized ads in Real Games Now (Android). As described in Section 5.8(b), when ads in Real Games Now on Android are personalized, advertising networks (currently Google, AppLovin and Meta) receive the following categories of Personal Information from your device: Identifiers (such as your device's advertising ID and IP address) and Internet or other electronic network activity information (such as device information and your interactions with ads). This may be a "sale" or "sharing" of personal information under California law, and "targeted advertising" under other U.S. state privacy laws. You can opt out at any time as described under "Right to Opt-Out" below. In Real Games Now, we do not sell or share the personal information of users we know are under 18.
Your California Privacy Rights
If you are a resident of the state of California, you have the following rights:

Right to Know. You may have the right to request information on the categories of personal information that we collected in the previous twelve (12) months, the categories of sources from which the Personal Information was collected, the specific pieces of Personal Information we have collected about you, and the business purposes for which such personal information is collected and shared. You also have the right to request information on the categories of Personal Information which were disclosed for business purposes, and the categories of third parties in the twelve (12) months preceding your request for your personal information.
Right to Delete. You may have a right to request us to delete Personal Information that we collected from you.
Right to Opt-Out. You have a right to opt-out of certain disclosures of Personal Information to third parties, if such disclosures constitute a “sale” under California law. As noted above, in the past twelve (12) months we enabled advertisers to collect certain information from the Site, which the advertisers may use to improve their interest-based advertising networks. Regardless of whether this is a “sale,” you may opt-out of interest-based advertising as described in Section 3.3, above. In Real Games Now, you can opt out of the sale and sharing of your Personal Information, including for personalized ads and for the ads described in Section 5.8(d), on the Me page in the app (Do Not Sell or Share My Personal Information) or at https://rgn.topgamesinc.com/m/rgn/do-not-sell.

If you would like to exercise your rights listed above, please contact (or have your authorized agent contact) us using the contact information listed below. When doing so, please tell us which right you are exercising and provide us with contact information to direct our response. We must verify your identity before fulfilling your requests. If we cannot initially verify your identity, we may request additional information to complete the verification process. 14.1. Procedure and Method of Destruction of Personal Information
Top Games destroys personal information without delay when the information becomes unnecessary, such as the lapse of the personal information retention period as outlined in section 6 or achievement of the purpose of processing as outlined in section 4 above.
